Employer Filing Season 2025: What South African Employers Need to Know

23 May, 2025

The South African Revenue Service (SARS) has officially opened the Employer Filing Season for 2025, running from 1 April to 31 May 2025.

This is a critical period for employers to submit their Employer Annual Declaration (EMP501) and ensure full compliance with tax regulations.

What Is the Employer Filing Season?

During this period, employers must reconcile:

  • Monthly EMP201 submissions (PAYE, SDL, UIF),
  • Payments made to SARS,
  • Employee tax certificates (IRP5/IT3(a)) issued for the tax year.
  • This reconciliation ensures SARS has accurate payroll data to support the upcoming Personal Income Tax Filing Season.

Penalties for Late or Incorrect Submissions

SARS has made it clear: non-compliance comes at a cost. If an employer fails to submit the EMP501 accurately and on time, the following penalties apply:

  • 1% of the total annual PAYE liability will be charged as a penalty for each month the submission is late.
  • This penalty increases monthly by 1%, up to a maximum of 10% of the total PAYE liability.
  • Incomplete or incorrect submissions may also be rejected, requiring resubmission and potentially triggering penalties.
  • Example: If your total PAYE liability for the year is R500,000 and you submit your EMP501 three months late, you could face a penalty of R15,000 (3% of R500,000).

What’s New in 2025?

SARS has released e@syFile™ Employer version 8.0, featuring:

  • Improved reconciliation tools,
  • Enhanced user experience,
  • Compatibility with the latest SARS systems.

Employers are encouraged to download the latest version from the SARS e@syFile page before filing.Considering Company Size:
